The compliance spread is real

Crail’s own data on this category shows a wide range: Gong carries the deepest bundle we’ve recorded — SOC 2 Type II, multiple ISO certifications (27001, 27017, 27018, 27701, 42001), HIPAA, PCI DSS, and CSA STAR — consistent with its enterprise revenue-intelligence positioning and quote-only pricing. Fireflies.ai and tl;dv both carry SOC 2 plus GDPR. Fathom, by contrast, had no compliance certifications on record at the time of our last check. None of this tells you which tool transcribes best — it tells you which one you can actually put in front of a regulated customer call.

Questions worth asking before rolling this out broadly

1. Does the free/cheap tier train on your call data by default? This is the single most consequential question in this category and the one most people skip.
2. Does it record external participants, and do they get notified? Meeting-recording consent law varies by jurisdiction (some US states require two-party consent) — this is a legal question for your team, not a product feature, but the tool needs to support whatever notice mechanism you land on.
3. Where is transcript data stored, and for how long? Especially relevant if sales or legal conversations are being recorded routinely.
4. Does it integrate with your CRM/calendar in a way that scopes access appropriately, or does it request broad account-wide permissions to work at all?
